New Delhi: The government is likely to decide on sending a Presidential reference to the Supreme Court in the alleged sexual harassment case of Justice (retd) AK Ganguly on Thursday.
Attorney General GE Vahanvati had earlier made an observation that the a case can be made against Justice Ganguly.
While Justice Ganguly has denied sexual harassment charges made against him, call is being made for him to quit his post as chairman of West Bengal Human Rights Commission.
If the Union Cabinet gives its nod, then it will be sent to President for approval who in turn will then pass on the same to Chief Justice of India.
The three-judge committee had earlier probed the allegations of sexual harassment levied by an intern on Justice Ganguly and had prima facie disclosed an "act of unwelcome behaviour" and "conduct of sexual nature" on the part of the retired judge.
The committee comprising justices RM Lodha, HL Dattu and Ranjana Prakash Desai was constituted by Sathasivam after media reports on November 12 that "a recently retired judge" misbehaved with a law intern.
Without naming the judge, she had written in a blog that when the country was discussing the December 16 rape incident in the capital, she had undergone a traumatic experience at the hands of a judge who made advances to her.
