New Delhi: The Delhi High Court slammed
state-owned National Textile Corporation (NTC) and imposed a
cost of Rs 50,000 for filing a "frivolous" petition
challenging each and every trial court order in an eviction
proceeding against it.
Dismissing the petition filed by NTC, Justice V B Gupta
directed the PSU to deposit the amount with the Registrar
General of High Court within four weeks.
"Frivolous litigation clogs the wheels of justice,
making it difficult for courts to provide easy and speedy
justice to genuine litigants. Public Sector undertakings
should not indulge in mindless litigation and unnecessary
waste of time and public money...," Justice Gupta said.
The court directed the NTC, a sick company, to collect
the amount from the salaries of delinquent officials who have
been pursuing this litigation.
The court order came on a petition filed by NTC
challenging the March 18 order of a civil court dismissing its
plea to restrain one Kunj Behari Lal, who rented his Laxmi
Nagar property to the company to run the office on lease, from
initiating recovery proceedings against it as the company
is sick.
