BMW case: Utsav’s bail plea deferred till tomorrow

The Patiala House court on Wednesday deferred hearing on the anticipatory bail plea of Utsav Bhasin, the prime accused in the recent BMW hit-and-run case in the capital. Incidentally, following the death of one of the victims Anuj Singh, Utsav has been booked under the non-bailable section of the IPC.

New Delhi, Sept 17: The Patiala House court on Wednesday deferred hearing on the anticipatory bail plea of Utsav Bhasin, the prime accused in the recent BMW hit-and-run case in the capital. Incidentally, following the death of one of the victims Anuj Singh, Utsav has been booked under the non-bailable section of the IPC.

Additional Sessions Judge Brijesh Garg, to whom the anticipatory bail application was marked, adjourned the hearing on the plea of Haryana industrialist`s son as the parties failed to produce the order of the Delhi High Court.

"This court wants to see the observations of the High Court on the petition filed by Dr Rajender Singh, father of victim Anuj Singh," the judge said.

Investigating Officer A S Rawat, however, submitted before the court that he would file the order of the High Court passed on Tuesday.

During the hearing, Bhasin`s counsel Ramesh Gupta said that Section 304 (culpable homicide not amounting to murder) was invoked by the police on their own and the High Court did not say anything in this regard.

Earlier on Tuesday, the Delhi High Court had cancelled Bhasin’s bail after Delhi Police slapped fresh charges against him of culpable homicide not amounting to murder under the harsher penal Section 304 (II) of the Indian Penal Code.

The new charges were filed based on a statement from Mrigank Srivastav, who survived the accident but lost his friend Anuj Singh.

The accident took place in South Delhi’s Lajpat Nagar area, near Moolchand flyover, at around 2.30 am last Thursday.

Anuj Singh succumbed to death after suffering injuries on cervical spine and slipping into coma.

Bhasin (19) was at the wheels, along with his girlfriend, when his car allegedly hit the men on motorcycle. The two immediately fled the scene. He was arrested hours later from Kashmiri Gate while trying to flee to Chandigarh, police said.

He was later released on bail after giving two sureties of Rs 20,000 each. A case under Sections 279 (rash and negligent driving) and 337 (causing hurt and endangering life) of the IPC was initially registered against him.

After Anuj’s death, police pressed more charges on Bhasin which included Section 304(A) – causing death due to rash driving.

The car is owned by a Bahadurgarh-based industrialist and father of Utsav, R K Bhasin, who owns M/s Golden Rolls Ltd. The car bears a VIP registration number from Haryana.

A Delhi HC judge on Sunday had instructed the police to seize Bhasin’s passport, who was likely to leave for Singapore to pursue his studies.
