Bar Council of India cannot take suo motu action

Bar Council of India (BCI) has not received any complaint so far against the two senior advocates, R K Anand and I U Khan, who were found allegedly influencing a witness in the sensational BMW case, as per the video clippings shown by a television channel.

Kochi, June 05: Bar Council of India (BCI) has not received any complaint so far against the two senior advocates, R K Anand and I U Khan, who were found allegedly influencing a witness in the sensational BMW case, as per the video clippings shown by a television channel.
Being an apex statutory body, the BCI will not normally take direct disciplinary proceedings against any lawyer in the country on the basis of media reports without a formal complaint before it on allegations of professional misconduct, BCI Chairman S Gopakumaran Nair told agencies here.

"If at all we receive a complaint of professional misconduct against any lawyer, we will forward the same to the respective state bar council, where the alleged misconduct had taken place", he said when asked if the BCI was contemplating action against the two lawyers.

The BCI would then request the state bar council to initiate disciplinary proceedings against the lawyers concerned, he said.

Nair said his personal opinion was that the persons being lawyers of some repute and standing, without knowing the truth behind the allegation and without getting evidence, it would be 'unfair' on the BCI's part to jump into conclusions and to take direct action against them.

"Being lawyers having some reputation and standing in the profession, they may be having political and professional opponents" and hence it would unfair to take any action against them without a formal enquiry, he said.

The Supreme Court Bar Association had yesterday suspended the advocates, while the Delhi Bar Council had constituted a three-member fact finding committee to look into issue.
