NEW DELHI: The Central government on Tuesday told the Supreme Court that the Aam Aadmi Party government in Delhi cannot be seeking privileges of a state government. The Centre told the bench headed by CJI Dipak Misra, that Delhi is a Union Territory and the AAP government cannot claim privileges of a state government.
Earlier in August 2016, the Delhi High Court had held the Delhi Lieutenant Governor as the administrative head of the National Capital Territory, which it said was still a union territory. The AAP government challenged this in the SC, contending that a “democratically elected government can’t be subservient to the L-G”.
The Supreme Court had recently observed that the L-G seems to have primacy under the Constitution and that the Delhi government cannot act without L-G's agreement.
The bench had said that the Constitution has limited Delhi government's powers. The court had said that the difference of opinion between the Delhi government and the Centre should be referred to the President to take the final decision.
